警察角色定位的理论检视与属性分析

摘　　要：通过对警察角色理论的检视,明确警察角色和警察的角色、警察角色和警察角色内容之间的差异,从而确定了警察角色政治性和法律性的双重属性。政治性是警察角色的本质属性,世界不同国家警察角色均具有政治性,尽管政治性的表现形式不尽相同。法律性是警察角色政治性的彰显和表达,政治性通过“社会秩序维护”这一警察核心目的嵌入法律性之中,从而确定了“暴力与服务”的双重内容。政治性和法律性是警察角色定位的两个维度,共同框定了警察角色形象。Through scrutinization of police role theories,this article clarifies the differences between the police role and role of the police,and the police role and content of the police role,thus identifying the dual attribute,i.e.,the political nature and the legal nature of the police role.Political nature is the essential attribute of the police role.Police roles in different countries of the world are all political,although manifestations of the political nature are not the same.Legal nature is the manifestation and expression of the political nature of the police role.The political nature is embedded in the legal nature through the core police goal of"maintaining social order",which decides the dual police content of"violence and service".The political nature and the legal nature are the two dimensions positioning the police role,which together determine the image of the police role.
