摘　　要：2018年以来,恶势力犯罪案件作为一类典型的黑恶势力犯罪类型显名在司法实践中。恶势力犯罪案件属于有组织犯罪的初级阶段,与其高级阶段的黑社会性质组织犯罪案件有所不同,因此,此类案件的侦查也有其特殊性,应慎用侦查经营策略,根据地域或行业实施精准侦查,注意恶势力整体与个案的关系。目前,此类犯罪案件侦查存在线索发现难、措施运用难、侦查取证难、性质把握难等困境,必须采取打造专业队伍、强化基础工作、充分发动群众、灵活运用措施、重视规范取证、准确辨明性质、全面追查涉案财产、克服制度缺陷等措施,才能有效打击恶势力犯罪,实现法律效果、政治效果和社会效果的统一。Since 2018,crimes committed by evil forces have become famous in judicial practice as a typical criminal type of evil forces.Crimes committed by evil forces belong to the primary stage of organized crime,which is different from those committed by underworld organizations in the advanced stage.The investigation of such cases also has its particularity.Therefore,we should carefully use the investigation management strategy,implement accurate investigation according to regions or industries,and pay attention to the relationship between evil forces as a whole and individual cases.At present,it is difficult to find clues,use measures,collect evidence and grasp the nature in the investigation of such criminal cases.Only by building a professional team,strengthening the basic work,fully mobilizing the masses,flexibly using measures,paying attention to standardizing evidence collection,accurately identifying the nature,comprehensively tracing the property involvedand overcoming system defects can we effectively crack down on crimes committed by evil forces and realize the unification of legal,political and social effects.
