论权利失效规则的司法适用——对“阿凡提”著作权纠纷案的体系解释

摘　　要：我国民法理论承认权利失效规则,司法实践亦在具体案例中予以适用。"阿凡提"著作权权属、侵权纠纷案呈现了以信赖要素为核心的权利失效规则体系的构成要素间彼此牵连、协同作用的逻辑关系,是适用权利失效规则的典型案例。该案对于权利失效规则适用的意义主要在于:以确权吸收权利失效效果的方式创新适用权利失效规则,为我国请求权适用权利失效提供了可资借鉴的样本,突出了权利失效规则体系中信赖要素的中心地位,引发对权利失效相对面的"得权"理念的思考。司法实践中,法官疏于运用体系方法适用法律,多数原因是法官运用体系解释方法的自觉性不够,另外还因为案件审理所适用的法律存在争议,法官又不能拒绝裁判,所以只能笼统说理。Civil law theory recognizes the rule of invalidity of rights,and judicial practice applies it in specific cases. The " Afanti" copyright case presents a logical relationship of mutual influence and synergy between the constituent elements of the system of rules for the invalidation of rights with trust as the core. The significance of this case for the application of the right to invalidation rules are mainly: Innovative application of the right rules in a way that confirms the right to absorb the effects of the invalidation of rights,provides a reference sample for the invalidation of the right to apply for rights in China,highlights the central position of the elements of trust in the system of rules for the invalidation of rights,and triggers the opposite of the invalidation of rights which’s. The concept of " empowerment". In judicial practice,judges failed to apply the system interpretation method to apply the law. The man reason’s that judges are not sufficiently conscious in applying the system interpretation method. In addition,because the law applicable to the trial of a case is controversial,the judge cannot refuse the decision,so he can only generalize.
