摘  要:1949年以来中国集体合同制度变迁主要经历了新中国成立初期和改革开放以后这两个时期。中国集体合同制度变迁是政府主导下的渐进性制度变迁,其直接动因是基于预防和化解劳动关系矛盾。中国经济体制改革(或变革)决定着集体合同制度变迁的路径和方向。随着全面深化改革的深入,中国市场化取向的经济改革将走向成熟,集体合同制度也必然会随着社会主义市场经济体制的健全完善而趋于成熟,其内生动力将日益增强、地位作用更加凸显、政府职能不断优化、制度规划将趋于完善。Since 1949,the change of China’s collective contract system has mainly gone through two periods:the early period of the founding of New China and the period after the reform and opening up.The change of China’s collective contract system is a gradual system change led by the government.Its direct motivation is to prevent and resolve labor relations contradictions.China’s economic system reform(or change)determines the path and direction of the collective contract system change.With the deepening of the comprehensive reform,China’s market-oriented economic reform will be mature,and the collective contract system will inevitably become mature with the improvement of the socialist market economic system,its endogenous power will be increasingly enhanced,its status and role will be more prominent,the government functions will be constantly optimized,and the system rules will be improved.
