完善渔业法规:明确破坏生态平衡捕捞行为的法律责任

摘　　要：现代捕捞业的快速发展使得当今渔业生态系统日益退化,非规范化捕捞业的发展使得渔业等生物资源难以维持正常种群数量。随着渔业资源的不断减少,人们使用破坏生态平衡手段进行捕捞,以追求经济利益最大化。当前《中华人民共和国渔业法》对该种行为规定较为模糊,为解决因破坏生态环境及其生态平衡的非规范化捕捞所造成的生态系统失调问题,全国人民代表大会必须及时对《中华人民共和国渔业法》进行修改。通过梳理渔业法对破坏生态平衡捕捞方式方法的法律责任问题,明确破坏生态平衡捕捞行为及其应当承担的法律责任,加强对捕捞行为的法律规制,保护渔业生态环境,为海洋生态系统可持续发展、国家治理能力现代化提供法律支持。The rapid development of modern fishing industry makes today’s fishery ecosystem increasingly degraded,and the development of non-standardized fishing industry makes it difficult for fishery and other biological resources to breed enough offspring to supplement their populations.With the decrease of fishery resources,to pursue the maximization of economic benefits,people has started to fish by means of destroying the ecological environment.At present,the provisions of the Fisheries Law of the People’s Republic of China on this kind of behavior are relatively vague.In order to solve the serious impact on the ecosystem caused by non-standardized fishing that damages the ecological environment and the ecological balance,the National People’s Congress must amend the Fisheries Law of the People’s Republic of China in a timely manner.By sorting out the legal liability of fishing methods and the methods that destroy the ecological balance in the fishery law,the behaviors of destroying the ecological balance and the corresponding legal liability will be specified.These measures can strengthen the legal regulation of fishing behavior and further protect the fishery ecological environment,which will provide legal support for the sustainable development of marine ecosystem and the modernization of national governance capacity.
