法益保护视角下携带凶器盗窃的认定

摘　　要：法益的解释论机能意味着对构成要件的解释离不开法益的指引。《刑法修正案(八)》第39条对盗窃罪的罪状进行修改,使得携带凶器盗窃作为一种特殊的行为类型得以入罪,其目的在于更加周延地实现对法益的保护。《刑法修正案(八)》所带来的盗窃罪条文表述和构成要件的变化表明立法理念已经产生了变迁,即从法益保护的单一化转向了法益保护的多元化,唯有复数法益说才能为携带凶器盗窃入罪提供正当性支撑。司法机关在认定携带凶器型盗窃时应当紧扣其真正的保护法益这一核心,确保其在对构成要件要素进行解释的过程中能够得出正义的解释结论,从而使得司法适用不统一的现象迎刃而解,实现刑法的法益保护和自由保障的任务。The interpretive function of legal interests means that the interpretation of the constituent elements cannot be separated from the guidance of legal interests.Article 39 of“Criminal Law Amendment(8)”amends the crime of theft,making theft with lethal weapon as a special type of behavior convicted,whose purpose is to realize the protection of legal interests more comprehensively.The changes in the expressions and constituent elements of the theft crime brought about by“Criminal Law Amendment(8)”indicate that the legislative concept has undergone changes,that is,from the simplification to the diversification of the protection of legal interests,so that only the plural of legal interest can be used to provide legitimacy support for the crime of theft with lethal weapons.When judiciary determines the theft with lethal weapons,the core of real protection of legal interests should be held to ensure that it can reach a just interpretive conclusion in the process of explaining the constituent elements,thereby making the inconsistent of judicial application solved easily and realizing the task of protection of legal interests and freedom of criminal law.
