摘 要:2020年4月,国际原油期货结算价出现历史性的“负价格”,中国银行“原油宝”产品发生了“穿仓”,对此银行要求客户承担本金之外数倍数额的经济损失。“原油宝”事件引发了各方的热烈讨论,人们纷纷质疑以安全稳健运营为特征的商业银行从事“原油宝”这类高风险业务是否合法,进而引发商业银行从事高风险业务应该如何进行法律监管的问题。“原油宝”事件涉及合法性、监管主体和监管措施三个核心问题。在我国金融混业日益深化的背景下,为了保障银行的安全稳健、防范系统性风险、保障我国金融安全,应明确限制商业银行的高风险混业经营业务,采取差异化监管理念,确定监管主体,从微观、中观、宏观层面强化法律监管措施。In April 2020,the international crude oil futures settlement price had a historical“negative price”,and the“Crude Oil Treasure”product of the Bank of China had“wearing positions”.For this,the bank required customers to bear the economic losses of several times of the amount in addition to the principal.The“Crude Oil Treasure”incident has triggered heated discussions among all parties.People have questioned whether it is legal for commercial banks that are characterized by safe and stable operations to engage in high-risk businesses such as“Crude Oil Treasure”,which in turn triggers supervisory issues on how commercial banks should conduct high-risk businesses.The“Crude Oil Treasure”incident involved three core issues:legality,supervisory bodies and supervisory measures.In the context of the deepening of China’s financial mixed industry,in order to ensure the safety and stability of banks,prevent systemic risks and protect China’s financial security,commercial banks’high-risk mixed operations should be clearly restricted,and the concept of differentiated supervision should be adopted to determine the supervisory body,to strengthen legal supervision measures from the micro,meso and macro levels.
