论警察执法权行使的立法保障与规制——基于《人民警察法》(修订草案)的分析

摘　　要：2016年12月1日公安部在其官方网站发布了《<中华人民共和国人民警察法>修订草案稿》,并向社会公开征求意见。这次修订草案作了较大幅度的调整和修改,增添了许多新内容,存在许多新亮点。其核心内容体现在两个方面:一是依法赋予和保障人民警察行使执法权,维护人民警察执法权威,依法惩治暴力袭警违法犯罪,保障人民警察的执法权益;另一方面也要规范和约束警察执法权的过度行使,防止其滥用,依法保护相对人的合法权益。人民警察法的修订把这两者结合起来,并寻求两者之间的平衡。On December 1,2016,the Ministry of Public Security published the revised draft of the people’s Police Law of the people’s Republic of China on the official website,and solicited comments from the public.The revised draft has made great adjustments and revisions,added many new contents,and also has many new bright spots.Its core contents are reflected in two aspects:one is to give the people’s police law enforcement power according to law,safeguard the people’s police law enforcement authority,and protect the law enforcement rights and interests of the people’s police;on the other hand,it is also necessary to standardize and restrain the excessive exercise of the police law enforcement power,prevent its abuse,and protect the legitimate rights and interests of the opposite party in accordance with the law.The amendments to the police law put these two People unite and seek a balance between the two.
