摘  要:公共警告已成为政府进行风险规制的重要手段,如果公共警告权行使不规范,就会侵害到公众或特定利害关系人的合法权益。为了促进公共警告权责统一原则的实现、规范公共警告权力、保障公共警告利害关系人的合法权益,必须加强公共警告责任追究立法。现阶段公共警告责任追究立法存在责任规定相对较少、责任主体不完善、责任标准不明晰的问题,为加强公共警告的责任追究,需要增加公共警告责任追究的相关规定,并完善责任主体和责任标准的内容,以减少纠纷发生,促进社会稳定发展。Public warning has become an important way for government to carry out risk regulation,if the exercise of public warning powers is irregular,it may also infringe upon the legitimate rights and interests of the public or specific interested parties.In order to promote the realization of the uniform principle of public warning authority and responsibility,regulating public warning power,protect the legitimate rights and interests of interested parties in public warning,the legislation of public warning accountability must be strengthened.At present,there are some problems in the legislation of public warning responsibility investigation,such as relatively few liability provisions,imperfect liability subjects and unclear liability standards.To strengthen the public warning accountability,it is necessary to increase the relevant provisions on the responsibility investigation of public warning,and improve the content of the responsible subjects and accountability standards,so as to reduce the occurrence of disputes and promote social stability and development.
