知识产权管理视域下中外专利资助政策比较

摘　　要：我国专利发展从数量爆炸式激增转向高质量内涵式发展的新阶段,专利资助政策的导向性作用尤为重要。在知识产权管理视域下,专利资助政策的资助目标包括专利创造、专利获取、专利维持、专利运用以及专利保护等环节。欧洲专利资助政策的特点在于资助对象主要是中小企业、资助方式多元化、资助目标涵盖专利活动各个环节等。国内典型专利资助政策的特点在于资助对象的范围宽泛、资助方式以直接补贴为主、资助目标向注重专利活动下游环节转变等。为促进我国专利从数量增长向高质量发展转型,专利资助政策的资助目标和资助力度应从注重专利获取向重点支持专利运用及专利保护等知识产权管理环节转变。In patent application,China is converting from explosive increase in quantity to high-quality connotative development,and the patent subsidy policy shows particularly important in guiding role. From the perspective of intellectual property management,the funding objectives of patent subsidy policy include patent’s creation,acquisition,maintenance,application and protection. The characteristics of European Patent funding policy remain its target for small and medium-sized enterprises,the diversified funding methods,and the funding objectives concerning all aspects of patent activities. The characteristics of typical patent subsidy policies in China are wide scope of subsidy objects,direct subsidy of funding mode,and more focusing on the downstream-link of patent activities. In order to promote the transformation of our patents from quantity growth to high-quality development,the goal and intensity of patent subsidy policy should be converted from patent acquisition to focusing on supporting patent application and patent protection and other aspects of intellectual property management.
