中美关系背景下的国家知识产权战略  

On China’s Intellectual Property Strategy Under the Background of Sino-US Relations

摘　　要：国家知识产权强国战略制定之际,恰逢中美关系日趋紧张。历经四十余年接触、交往和冲突,本轮中美知识产权纠纷引发的贸易冲突,目前已经影响到中美关系的各个领域。中国的国家知识产权战略通过确立私权制度、促进知识产权壮大之后,历经各种制度转换和建设,目前也已经进入知识产权强国建设阶段。这一时期,中美"泛知识产权"领域存在的结构性冲突,同时也是中美两国战略性冲突的重要组成部分,促使知识产权外交逐渐成为维系两国关系的一条技术路线。这一时期的知识产权战略应该强基固本,内外兼修:促进中美战略互信,强化知识产权保护;改革体制,实现知识产权治理的现代化;融贯创新,重塑知识产权的价值链;"多边""小多边""双边"及"单边"等"四边联动",推进知识产权国际合作。While China is formulating the intellectual property powerhouse,the Sino-US relationship grows tense.After four decades of contacts,engagements and conflicts,the current round of trade conflicts triggered by SinoUS intellectual property disputes has influenced all areas of Sino-US relations.Upon establishing a private right system and promoting intellectual property rights,China’s national intellectual property strategy has undergone various system transformations and construction,and is now heading for the stage of building an intellectual property powerhouse.During this period,the structural conflicts in the field of"pan-IP"between China and the United States also play an important part within the Sino-US strategic conflicts,the structural conflicts will cause intellectual property diplomacy to gradually become a technical route in terms of Sino-US relation maintenance.Intellectual property strategy during this period should strengthen the foundation of both internal and external coordination,and specifically be implemented in four aspects:promote strategic mutual trust between China and the United States and strengthen intellectual property protection;reform the system and achieve the modernization of intellectual property governance;actualize innovation comprehensively and reshape the intellectual property value chain;establish a’quadrilateral correlation’that consists multilateral,minor multilateral,bilateral and unilateral mechanisms,to push forward international intellectual property cooperation.
