摘 要:商标问卷调查已成为国外司法审判中的常规证据,在我国也已引起学者们的重视。对司法裁判文书的实证研究发现,我国商标问卷调查的司法应用具有三个特点:第一,商标问卷调查的应用率极低;第二,商标问卷调查主要由当事人在较难证明的案件中提出,用于测度商标法中的多种问题;第三,商标问卷调查的采信率整体偏低。对研究样本中所载的问卷调查进行微观分析,发现我国司法中应用的商标问卷调查在专家资质、对象选择、模型设计、规范执行、科学报告等五个方面普遍存在问题。为解决上述问题,应当明确商标问卷调查的证据属性,消除引入此类证据的不确定性;构建引入商标问卷调查的合理程序,保障其中立性和客观性;制定应用商标问卷调查的司法指引,引导当事人提升问卷调查质量,帮助法官正确审查问卷调查证据。Trademark surveys have become regular evidence in foreign jurisdictions.It also draws the attention of Chinese scholars.Empirical study of the trademark cases in China shows that there are three features of the judicial application of trademark surveys in China.First,the application rate of trademark surveys is extremely low.Second,trademark surveys have been submitted by parties to prove different issues in difficult trademark cases.Third,the admission rate of trademark surveys is also low.Detailed study on the trademark surveys used in China’s trademark cases shows that these surveys have defects in five aspects,including the qualification of experts,the choice of respondents,the design of formats,the enforcement and the report of the surveys.In order to solve the above problems,the evidentiary nature of trademark surveys needs to be cleared,so that the uncertainty of admitting trademark surveys could be eliminated.Second,reasonable procedures to admit trademark surveys need to be constructed,to ensure the neutrality and objectivity of trademark surveys.Third,judicial guide on the application of trademark surveys needs to be formulated,to help parties to improve the quality of trademark surveys and the judges to properly review them.
