论林木所有权的物权限制及其突破

摘　　要：尽管我国相关法律多处规定了“林木所有权”,但同时也对林木所有权的取得、行使、处分等进行了一系列的限制。这种限制主要体现在林、地一体主义的物权变动模式对林木流转、抵押、继承等方面的限制。这种物权限制系出于公共政策的考虑。随着社会环境发展变化,需要对林木流转、抵押、继承上的限制区分两种情况进行革新。一方面,保持林、地一体变动的主流,对于较多依赖林地使用的林木,将林地经营权作为林木所有权的主要权源,进而破除对林木所有权的相关限制;另一方面,对于较少依赖林地或单株价值较高的林木,赋予其独立的所有权,允许其脱离林地权利单独流转、处分和登记,最大限度发挥其融资功能,从而为现代林业发展注入生机。Although China's relevant laws provide“forest ownership”in many places,they also impose a series of restrictions on the acquisition,exercise,and disposal of forest ownership.This kind of restriction is mainly reflected in the restrictions on forest circulation,mortgage,inheritance,etc.in the mode of change in property rights of forest and land integration.This restriction of property rights is based on public policy considerations.With the development and change of the social environment,it is necessary to innovate the two cases of forest circulation,mortgage and inheritance restrictions.On the one hand,we should maintain the changes in forest and land integration as the mainstream.For forests that rely more on forest land use,forest land management rights are used as the main source of forest ownership,and the related restrictions on forest ownership should be broken.On the other hand,there is less dependence on the forest land or individual tree with higher value is given independent ownership,allowing it to be transferred,disposed of,and registered separately from the forest land rights to maximize its financing function,thus to bring new vigor and vitality into the development of modern forestry.
