学术期刊出版工作中容易被忽视的法律问题

摘　　要：在我国已形成具有中国特色的出版法律体系背景下,学术期刊出版工作中仍存在容易被出版单位忽视的法律问题,如编辑工作开始前的出版协议具体内容、编辑工作过程中的文章修改、编辑工作结束后的稿费支付等。这些都是学术期刊出版单位所熟知,但不被重视且常态化存在的问题,随着作者维权意识的觉醒,不可避免会产生法律纠纷。学术期刊出版单位除了要关注期刊的专业发展外,还要多加留意与期刊出版相关的法律规范的更新,努力提升编辑的法律素养,按照出版法律法规规范操作,做到以上几点是完全可以避免这些法律纠纷出现的。Under the background that China has formed a publishing legal system with Chinese characteristics,there are still legal problems easily ignored by publishers in academic journal publishing,such as problems related to the specific content of publishing agreement before editing,the modification of articles in editing and the payment of contribution fee after editing.Though these problems are well known to academic journal publishers,they have been ignored for a long time.With the rising awareness of public rights protection,the legal disputes are inevitably arising.Therefore,in addition to the professional development of journals,academic journal publishers should pay more attention to the updating of laws and regulations related to journal publishing,strive to improve the legal literacy of editors and work in accordance with the publishing laws and regulations,so as to avoid these legal disputes.
