国际金融中心建设与混合型法律制度创新——以阿联酋阿布扎比国际金融中心建设为例

摘　　要：近年阿联酋通过在成文法法域内引入判例法机制的方式创设了迪拜和阿布扎比两个国际金融中心。这种基于混合型法律制度的创新模式为金融中心构建了独立的、平行于阿联酋联邦法律的普通法体系,特别是阿布扎比国际金融中心直接将对英国法的适用纳入自身法律体系,包括英国法院的判例。阿布扎比国际金融中心还尝试跨境金融监管,打造独立司法环境,成为"混合法"下建设国际金融中心的一个成功样本。在金融科技创新与全球化的驱动下,当前全球金融竞争格局日益激烈,我国基于"混合法"制度创建国际金融中心,既需要吸收阿布扎比国际金融中心创建模式的成功经验,也需要结合实际国情做到具体问题具体分析。In recent years,the UAE has created two international financial centers DIFC and ADGM,by introducing a case law mechanism into the legal jurisdiction.This innovative model based on the mixed legal system has built an independent common law system for the financial center,which is parallel to the UAE federal law.In particular,the Abu Dhabi Global Market directly incorporated the application of English law into its own legal system,including the jurisprudence of English courts.The Abu Dhabi Global Market also tried cross-border financial supervision and created an independent judicial environment,which provided a successful example for the construction of an international financial center under“mixed jurisdictions”.Driven by the innovation of finance,science technology as well as globalization,current global financial competition is becoming increasingly fierce.To establish an international financial center based on a“mixed jurisdiction”system in China,it is necessary to absorb the successful experience of the Abu Dhabi Global Market creation model,and to analyze specific problems in combination with the actual national conditions.
