摘　　要：通过《民法典》中民事主体的权利分析,对现有法律法规中“两新”组织工会档案处分的规定、工会财产的规定,就“两新”组织档案管理法规制定中工会档案权属、处分规定不清晰,与工会组织的职能和性质不符,提出依法治档,明确“两新”组织工会档案所有权,创新“两新”组织工会档案管理方式,采取“双轨双套制”或自主管理方式,完善国家档案信息资源的建议。Based on the analysis of the rights of civil subjects in the Civil Code and the provisions of the existing laws and regulations on the disposition of trade union archives and the property of the trade unions in the“two new”organizations,this pape puts forward proposals for managing the archives according to law,clarifying the ownership of the archives of the“two new”organizations,innovating the management mode of the archives of the trade unions in the“two new”organizations,adopting the“two-track and two-set system”or the independent management mode,and perfecting the information resources of the state archives in order to solve the problems of the unclear provisions on the ownership and disposition of the trade unions archives,and the inconsistency with the functions and nature of the trade union organizations in the formulation of the regulations on the administration of the archives of the“two new”organizations.
