摘 要:作品数字复制件可否转卖实际上也就是当作品载体以数字形式存在时是否可以适用权利穷竭原则的问题。权利穷竭原则产生的两大根基在于作品复制件所有权对作品著作权的限制以及著作权法维护著作权人利益与社会公共利益平衡的立法目的。故当作品载体以数字形式存在时,其是否可以适用权利穷竭原则,也需从上述两个维度分别予以考察,在明确作品数字复制件可以构成物权客体以及转卖作品数字复制件过程中会过度损害著作权人利益的基础上,得出只有在著作权人利益得到保障的情况下作品的数字复制件才得以自由转卖的结论,同时就如何在该过程中保障著作权人利益提出原则性规定与具体技术措辞并行的建议,以规范作品数字复制件转卖市场。Whether the digital copy of the work can be resold is actually a question that whether the principle of exhaustion of rights can be applied when the work carrier exists in digital form. The two roots of the principle of exhaustion of rights are the limitation of the copyright of the work imposed by the ownership of work carrier and the legislative purpose of the copyright law to maintain the balance between the interests of the copyright owner and the public interest of the society. Therefore, when the work carrier exists in digital form, whether the principle of exhaustion of rights is applicable also needs to be investigated respectively from the above two dimensions. In clarifying that the digital copy of the work can constitute the object of real right and the interests of copyright owner will be damaged in the process of resale, the author intends to reach a conclusion that the digital copy of the work can be freely resold only when the interests of the copyright owner are protected, and at the same time, some suggestions are put forward on how to protect the interests of the copyright owners in the process, which include the principle provisions and the specific technical measures, in order to standardize the resale market of digital copies of works.
