摘　　要：近年来艾滋病患者侵害其配偶民事权利问题备受关注。其侵权特点主要表现为危险行为持续、侵权客体交错、侵权行为隐蔽、追究责任困难。艾滋病患者所侵害的其配偶的具体民事权利主要为婚姻自主权、健康权、性自主权、生育权、财产权五个方面。为有效解决艾滋病患者侵害其配偶民事权利这一问题,可以从婚姻自主权的救济、增加婚姻可撤销条件中的特殊侵权情形、完善离婚损害赔偿制度以及在分割共同财产时向无过错方倾斜等方面进行救济。In recent years,the issue of HIV/AIDS patients infringing on their spouses’civil rights has attracted much attention.The main characteristics of tort are the continuity of dangerous acts,the interlacing of the objects of tort,the concealment of tort and the difficulty of investigating the responsibility.The specific forms of HIV/AIDS patients’infringement on their spouses’civil rights are mainly reflected in five aspects:marriage autonomy,health right,sexual autonomy,reproductive right and property right.In order to effectively solve the legal approaches for AIDS patients to infringe their spouses’civil rights,we can solve it by the following ways:the relief of marriage autonomy,increasing the special infringement cases in the revocable marriage system,improving the divorce damage compensation system,leaning towards the innocent party when dividing joint property and so on.
