摘　　要：目前我国关于森林生态效益补偿法律机制的研究还处于探索阶段,存在着法律体系不完善、补偿方式单一、补偿标准不合理等问题。为保障森林生态效益的可持续发展,提高森林生态效益提供者的积极性,有必要借鉴国外的成功经验。文章以我国《森林法》和新《环境保护法》为依据,借鉴美国、日本和德国在森林生态效益补偿法律机制方面的经验,并结合我国具体国情,从构建森林生态效益补偿法律体系、实行森林生态效益补偿方式多样化和补偿标准科学化等方面入手,提出完善我国森林生态效益补偿法律机制策略。At present,the research on the legal mechanism of forest ecological benefit compensation in China is still in the exploratory stage,and there are some problems,such as imperfect legal system,single compensation method,unreasonable compensation standard and so on.In order to ensure the sustainable development of forest ecological benefits and improve the enthusiasm of forest ecological benefit providers,it is necessary to learn from the successful experience of foreign countries.Based on Forest Law of the People′s Republic of China and Environmental Protection Law of the People′s Republic of China,the experience of the United States,Japan and Germany,and the specific national conditions,this paper proposed to improve the legal mechanism of forest ecological benefit compensation in China from the construction of the legal system,the diversification of compensation methods and the scientific compensation standards.
