村基层组织人员贪污贿赂罪主体研究——基于规范刑法学

摘　　要：全国人大常委会通过立法解释,规定了村基层组织人员拟制为国家工作人员,进而将其作为构成贪污贿赂罪的要件,但却没有明确村基层组织人员的具体范围。从“村基层组织”和“人员”两个概念入手,作为贪污贿赂罪主体的村基层组织人员应当是指在农村基层组织、村民委员会、集体经济组织、村民委员会下属委员会中具有一定职务,履行管理职能的人员以及大学生村官。The Standing Committee of the National People's Congress passed legislative interpretations,identifing the members of village grass-roots organizations as state workers,which constitutes the crime of corruption and bribery,but it has not specified the concrete scope of village grass-roots organization members.Starting from the concepts of"village-level organization"and"personnel",the village-level organization personnel who are the subject of the crime of corruption and bribery shall refer to those in the CPC grassroots organizations,village committees,collective economic organizations,and subordinates of village committees,who hold certain positions and perform management functions,and college student village officials.
