行政执法权重心下移的制度逻辑及其理论展开

摘　　要：行政执法权重心下移是行政执法体制改革的核心内容与实现国家治理体系和治理能力现代化建设的重要抓手,但由于行政执法权重心下移制度的缺陷和供给的不足,使得其在实践中呈现出偏离法治要求和国家政策的倾向,因此制度的重构是实现行政执法权重心下移良性运行的必然选择。在进行制度构设之前,我们有必要回到行政执法权重心下移的实然和应然逻辑之中,从本体和价值两个维度勾勒行政执法权重心下移制度建设的理论坐标,在基层社会治理的背景和行政合法性的语境中反思行政执法权重心下移可能带来的风险和挑战、探求制度化和规范化的基本着力点。在具体制度建构上,应当警惕和反思"属地管理"原则在行政执法权重心下移中作用的绝对化,而需将行政执法权重心下移自身的限度、分级负责原则与归口管理在执法权配置中的意义充分吸纳进来,在此基础上从受权主体适格、授权主体法定以及下移权限适度三个方面进行制度设计,以此实现行政执法权重心下移制度合法性与有效性的融合。The administrative law enforcement downward move is the core content of administrative law enforcement system reform and realize national modernization management ability and the management system of main fulcrum,but due to the defects of the system of administrative law enforcement of center of gravity down and supply shortage,make it present a deviation from the rule of law in practice and the tendency of national policy,so the system reconstruction is to realize the administrative law enforcement of success of the inevitable choice of benign operation.Before system design,we have had to return to the administrative law enforcement of the success of reality and logic,draw the outline of the administrative law enforcement from the ontology and the value of two dimension downward move coordinate system of the construction of the theory,the basic background of social governance and administrative legitimacy the reflection in the context of administrative law enforcement downward move may lead to risks and challenges,to explore the basic focus of institutionalization and standardization.On the concrete system construction,should be alert and reflection"territorial management"principle in the administrative law enforcement in the success of the role of the absolute,and the administrative law enforcement must be the center of gravity down their own limits,the principle of grading is responsible for and to manage in the allocation of law enforcement and meaning fully absorb,on this basis,from the authorized subject eligibility,legal and authorized subject down permissions moderate three aspects for the design of system,to implement the administrative law enforcement system of center of gravity down the fusion of legitimacy and effectiveness.
