摘　　要：奥大利亚烟草普通包装案是WTO争端解决机构对技术法规进行必要性检验的典型案例本文从必要性检验的前提条件、必要性检验判断的两阶段方式以及证明责任配置三个角度,对澳大利亚烟草普通包装案进行评析,并就技术法规必要性检验的思考与启示做了有益探索。The Australian Tobacco Plain Packaging Case is a typical case of the WTO Dispute Settlement Body on testing the necessity of technical regulations.This paper analyzes the case from three aspects,including the prerequisite of necessity test,the twostage method of necessity test judgment and the allocation of burden of proof,and puts forward some thoughts and ideas on the necessity test of technical regulations.
