兵家思想与传统“法治”——以《孙子兵法》为例

摘　　要：兵家思想是传统"法治"的滥觞,其集大成之作《孙子兵法》中有着对传统"法治"形式意义上的表达和实质意义上的表达。该著作中有关国家治理、秩序目的、多元治理、军队管理与编制等的具体论述,可以作为传统"法治"的源头去探讨,亦可作为中国传统法律思想的一部分去研究。Chinese Militarists’Thoughts is the source of traditional"rule of law".As its representative work,Master Sun’s Art of War contains the formal expressions and substantive expressions of traditional"rule of law".The content of governance of country,purpose of order,multiple governance management and establishment of army,specific methods of military management and etc in Master Sun’s Art of War can be discussed as the source of the traditional"rule of law",and can also be studied as one part of Chinese traditional legal thoughts.
