摘　　要：“首都功能”的维护与提升是国家依据宪法建设首都的宪法行为,“首都功能”亟待宪法层面的阐释。在宪法第143条中,“首都”通过概念涵摄奠定了“首都功能”的法源基础,明确“首都功能”至少应当包括全国政治中心、文化中心、国际交往中心等功能;首都条款的命令内容奠定了“首都功能”的权源基础,揭示出宪法赋予中央和地方国家机关维护和提升北京首都功能的宪法职责(权)以及“禁止”和“命令”两种行为模式。此外,北京与首都以及北京与首都功能之间形成的宪法关系为“首都建设”提供了参考坐标。The maintenance and promotion of“capital function”is the constitutional act of the country building the capital according to the Constitution,the“capital function”requires interpretation at the constitutional level.According to the interpretation of article 143 of the Constitution,the capital function should at least include the functions of the national political center,cultural center,international communication center,etc.,which laid the foundation of the origin of law content;the order content of the capital clause lays the foundation of the original of powers of the capital function,and reveals the constitutional responsibility(right)granted by the Constitution section to the central and local state organs to maintain and improve the function of the capital of Beijing and the two behavior modes of prohibition and order.In addition,the Constitutional relationship between Beijing and the capital and between Beijing and the capital function provides reference coordinates for the construction of the capital.
