摘 要:按新修订的《中华人民共和国行政诉讼法》第二十六条的规定,行政复议机关在作出维持决定后,相对人不服复议决定而起诉的,复议机关和作出原行政行为机关为共同被告。此规定虽然在一定程度上有利于打破行政复议“维持会”的僵化情势,但其导致行政资源和司法资源浪费,致使复议机关应诉压力增加而影响日常行政工作,造成复议机关不作为或者滥用驳回申请而变成“驳回会”的问题却不容忽视。通过吸纳专业人才担任复议工作;尊重原告诉权,不同案件区别对待;委托公职律师代表复议机关应诉等途径或可解决此制度设计带来的新问题。Article 26 of the newly revised Administrative Procedure Law stipulates that if the relative party refuses to accept the reconsideration decision and brings a suit after an administrative reconsideration organ makes a maintenance decision,the reconsideration organ and the organ making the original administrative act shall be the joint defendant.Although this provision is helpful to break the rigid situation of administrative reconsideration“maintenance meeting”to some extent,it leads to the waste of administrative resources and judicial resources,which leads to the increase of the pressure on the reconsideration organ to respond to the lawsuit and affects the daily administrative work.The new problems brought about by the system design can be solved by attracting professionals in the reconsideration work,respecting the plaintiff s right of action,entrusting public lawyers to answer the appeal on behalf of the reconsideration organ and treating different cases differently.
