摘 要:在人工智能时代采取电子形式订立劳动合同具有正当性、必要性和可行性。电子劳动合同与新型用工形式密切相关,对于新冠疫情防控长效机制之建立具有重大实益。电子劳动合同订立的核心是电子意思表示,其成立、传达、解释、错误等以意思表示的归责性理论为基础。对电子劳动合同订立过程中的各种风险应予以防范,针对劳动者与用人单位的身份差异,可分别适用不同的规则。以电子劳动合同的发展为契机,可以建立智能化的劳动合同信息系统和劳动争议处理系统,以提高劳动关系管理和服务的效能,快捷处理劳动争议。Electronic labor contract,which is closely related to new forms of employment and is of great benefit to the prevention und control of the coronavirus pneumonia situation,has legitimacy,rationality and necessity.Electronic labor contract whose essential is electronic will can be applied common law,however the establish,send out,interpretation,mistake of that are different from traditional will and based on the imputation theory,moreover all kinds risk of those should be on guard.On the identity differences between workers and employers,different regulations can be applied.Taking electronic labor contract as an opportunity,the intelligent labor contract information system and labor dispute processing system could be set up,in order to improve the management and service of labor relations and to deal with labor disputes more quickly.
