摘  要:高度危险作业区域的管理人与作业人为同一危险源的共同控制人,对危险实现造成的损害负连带赔偿责任。《民法典》第1243条的"高度危险活动/物"与高度危险责任章的"高度危险(作业)"内涵及外延一致,故高速公路非属本条"高度危险活动区域",最高人民法院法释[2012]19号解释第9条第2款的思路应予修正。危险作业区域管理人的责任不以过错为要件,但犯下额外过错的,不得援引受害人过错抗辩而减轻责任。本条并无特别书写必要,写为专条是中国侵权责任立法过度类型化弊病具体而微的表现。The manager of a special area designed for highly dangerous activity and the operator engaged in such activities are co-controllers of the same risk source and should jointly and severely liable for the injury caused by those risks.The risk activities referred to in article 1243 are identical to the high-risk operation in article 1236,sothe interpretation that freeways are area for dangerous activities which was adopted by Supreme Court should be abandoned.The manager’s liability doesn’t depend on fault,but extra fault would exclude the defendant from resorting to contributory negligence.Article 1243 was product of a technical error which was rooted in the systemic failure of excessive categorization.
