摘　　要：我国目前学界对于冷冻胚胎的法律属性众说纷纭,而司法实务中有关判决以回避这一理论困境则选择“利益论”;针对在现代社会不断变化的客观现实中日趋复杂的法律关系,在冷冻胚胎个案中采用利益衡量这一更灵活的模式应对冷冻胚胎的归属问题,有望形成符合中国国情的冷冻胚胎权利处置模式。At present,there are different opinions on the legal property of frozen embryos in China,but in judi⁃cial practice,in order to avoid this theoretical dilemma,we choose the interest theory.In view of the increasingly complex legal relationship in the changing objective reality of modern society,a more flexible mode of interest mea⁃surement is adopted in the case of frozen embryos to deal with the ownership of frozen embryos,which is expected to form a right disposal mode of frozen embryos in line with Chinese national conditions.
