摘　　要：西方体育产权的私有论与中国体育产权的模糊论反映了体育产权概念本身具有确定性和不确定性的双重属性。摒弃中西在体育产权方面的唯私有论和唯经验论,才能明确中国体育产权发展的趋势是走出模糊地带走向带有明晰特征的现代产权制度。受制于中国既有的经济制度和职业体育市场化发展的内在要求,体育产权内涵带有公私属性并存的特征,但这并不妨碍公-私二元体育产权制度的确立,尤其是体现体育市场精神的开放性、独立性以及法治化的二元产权结构是未来一定时期内体育产权概念建构的重心。The private theory of western sports property rights and the fuzzy theory of Chinese sports property rights reflect that the concept of sports property rights itself has the dual attributes of certainty and uncertainty.Abandoning the only private theory and empirical theory of sports property rights in China and the West,can it be clear that the development trend of China's sports property rights is to move out of the fuzzy zone to a modern property rights system with clear characteristics.Restricted by China’s existing economic system and the inherent requirements of the market-oriented development of professional sports,the connotation of sports property rights has the characteristics of coexistence of public and private attributes,but this does not hinder the establishment of a public-private dual sports property rights system,especially reflecting the sports market The openness and independence of spirit and the dual property rights structure of the rule of law are the focus of the construction of sports property rights in a certain period in the future.
