网络传销案件侦查思路的再审视——以电子数据为视角

摘　　要：作为新型网络犯罪代表的网络传销犯罪具有新特征,打击遏制此类犯罪要充分重视电子数据的重要作用。通过对该类案件中电子数据的内涵及鉴定人出庭质证过程的分析,解构了电子数据对案件侦查过程和侦查结果的影响,以及鉴定人出庭对侦查思路改进的影响。在发挥原有侦查经验优势的基础上,兼顾侦查空间的双重性,结合网络传销犯罪发展趋势,选择适合网络传销案件的侦查路径,探索案件侦办新思路。As one typical new cyber-crime,internet pyramid selling crime has new characteristics.The importance of digital evidence must be fully recognized in order to crack down the crime.Through the analysis of the connotation of digital evidence and the process of the digital forensic examiners'cross examination in court,this paper deconstructs the influence of digital evidence on the investigation process and results of such cases as well as the influence of the examiners appearing in court on the improvement of investigation ideas.On the basis of taking advantage of traditional investigation experience,considering the duality of investigation spaces,choose the investigation path to adapt to the development trend of Internet pyramid selling cases,and explore new ideas for crime investigation and handling.
