数字关境对我国数字市场开放的意义及政策涵义

摘　　要：数字贸易作为国际贸易演化的最高形态,表现出其独特的贸易特征。在确保国家数字安全的前提下,合理化数字贸易“边境内措施”,保障数据有序自由流动成为繁荣数字贸易的重要政策基石。正如传统海关特殊监管区在贸易领域发挥至关重要的渐进开放作用一样,通过构建数字关境,创新海关特殊监管手段和方法,将为解决数字贸易壁垒和限制,循序渐进开放数字市场提供全新思路。本文开头描述了数字贸易区别于传统贸易和价值链贸易的特殊性;第一部分通过数字贸易概念和分类综述,充分论述这种特殊性在贸易对象、部门及手段方面的具体表现;第二部分强调在遵循市场开放基本原则基础上的渐进式开放是实现数字贸易自由化的最优路径;第三部分引入数字关境概念,强调其对数字贸易渐进式开放的作用;第四部分提出构建数字关境条件下海关数字贸易特殊监管创新的政策涵义。As the highest phase of international trade evolution,digital trade shows unique trade characteristics.On the premise of ensuring national digital security,rationalizing“behind-the-border measures”of digital trade and ensuring the orderly and free flow of data has become an important policy cornerstone for flourishing digital trade.Just as the traditional customs special surveillance zone plays a vital role in the gradual opening up of international trade,innovating customs special surveillance means and methods by constructing digital customs territory will provide a new idea for solving the digital trade barriers and restrictions and opening up the digital market step by step.The beginning of this article describes the particularity of digital trade that is different from traditional trade and value chain trade.The first part,through the review of literature on the concept and classification of digital trade,fully discusses the specific performance of the particularity in the trade object,sector and means.The second part emphasizes that gradual opening up of digital trade is the best way to realize digital trade liberalization.The third part introduces the concept of digital customs and emphasizes its role in the gradual opening of digital trade.The fourth part puts forward the policy implication of the customs special surveillance innovation under the digital customs condition.
