摘　　要：如何看待商标品质保证功能的规范地位直接决定了商标权人排他权行使之范围,具有理论和实践的重大意义。考虑到商标品质保证功能的实现与否直接关系着商标法目的的达成,因此应明确其规范构成,并在此基础上具体解决商品流通环节中可能出现的商标侵权判断问题。The normative status of trademark’s function in quality guarantee explicitly defines the scope of exclusive rights entitled to trademark owner,hence is of significant theoretical and practical meaning.Given that the realization or not of trademark’s function in quality guarantee directly relates to the accomplishment of trademark law purpose,it should therefore to clarify the elements of the norm,and on which basis address the problems of judging trademark infringement emering in commodity circulation.
