基层群众自治组织参与突发公共卫生事件治理的法治思考

摘　　要：基层群众自治组织参与突发公共卫生事件治理是法律安排,更是客观需要,其不仅能够以自治的形式分担政府治理负担,提升突发公共卫生事件应对效率,还能体现基层群众自治制度蕴含的社会主义民主特性,增强突发公共卫生事件应对的合法性。从理想回到现实,基层群众自治组织在参与疫情防控过程中暴露的自治权失范、功能错位等现象,显示出了社会基层应对突发公共卫生事件存在的体制与机制问题。对此,提升基层群众自治组织参与突发公共卫生事件治理能力,需要建立健全协同治理体制与依法治理机制,一方面立足于基层群众自治制度自身建设,解决自治权运行以及基层群众自治组织协助政府工作等方面存在的突出问题;另一方面则需要回到多元协同的突发公共卫生事件治理体制中,具体确定基层群众自治组织在其中的主体性职责与工作机制。It is not only a legal arrangement,but also an objective need for grassroots autonomous organizations to participate in the governance of public health emergencies.It can not only share the burden of government governance in the form of autonomy,improve the response efficiency of public health emergencies,but also reflect the socialistic and democratic characteristics of grass-roots mass autonomy system,and enhance the legitimacy of public health emergency response.From ideal to reality,the problems of autonomy anomie and functional dislocation exposed by grassroots self-government organizations in the process of participating in epidemic prevention and control show the existing system and mechanism problems of social grass-roots response to public health emergencies.In this regard,to enhance the ability of grassroots self-government organizations to participate in the governance of public health emergencies,it is necessary to establish and improve the collaborative governance system and governance mechanism according to law.On the one hand,based on the self-construction of grass-roots mass self-government system,we should solve the outstanding problems in the operation of autonomy and the assistance of grass-roots mass self-government organizations in government work;on the other hand,we need to return to the multi collaborative governance system of public health emergencies,and specifically determine the main responsibility and working mechanism of grass-roots self-government organizations.
