由一则案例引发的海运提单抬头的写法思考

摘  要:海运是国际贸易中的主要运输方式,在海运方式下承运人或其代理人出具的海运提单(简称提单)是贸易中最重要的运输单据之一,其最基本的一个性质就是物权凭证,即谁是提单的合法持有者,谁就拥有货物的所有权。国际贸易中,对货物所有权的控制既关系到卖方能否安全收到货款,又关系到买方能否按时收到货物,也与开证行能否收回已付货款密切相关,这也是国际贸易相关各方极为关注的方面。而货物所有权的归属主要依据提单的抬头即收货人的写法。通过对一则无正本提单放货的案例引入提单的不同抬头写法,来分析在不同的提单抬头方式下,货物所有权的控制问题,并对如何防范实际业务中的风险给出具体建议。Sea transportation is the main way in international trade,and the transport document by sea that we called Bill of Lading issued by carrier or his agent is very important,which is the title deed to the goods.That is to say the person who holds the Bill of lading legally,he or she will control the goods.In international trade,the goods control is related with the payment of goods for the seller and the receiving the goods on time for the buyer,as well as the recovery of advance payment for the issuing bank,which is the key point that the related trade parties care about.While,title deed to the goods mainly depends on the title of consignee.This article is to analyze the goods control and give specific suggestions of preventing the risks in practice with different title of consignee by a case of delivery without original Bill of Lading.
