摘 要:农民环境权的保护虽然从宪法到环境法均能找到法律依据,但我国当前农民环境权的法律保护仍存在保护体系不健全、保护意识淡薄、权利主体法律地位弱等方面的不足。为保障乡村生态振兴战略的顺利实施,须完善农民环境权保护机制:首先,在立法上完善农民环境权保护的法律依据,在执法上切实保护农民环境权益,在司法上强化农民环境权益保护,健全农民环境权法律保护体系;其次,增强农民环境权法律保护意识;最后,提高农民环境权主体法律地位。Although the establishment of farmers’environmental rights can find legal basis from the constitution to the environmental law,there are various deficiencies in the legal protection of farmers’environmental rights.For example,the system of legal protection of farmers’environmental rights is not perfect,the awareness of legal protection of farmers’environmental rights is not high,and the legal status of farmers’environmental rights is too weak.In order to ensure the implementation of the rural ecological revitalization strategy,China should actively adopt the following measures:Firstly,improve the legal protection system of farmers'environmental rights.Secondly,strengthen farmers’awareness of the protection of environmental rights.Thirdly,raise the legal status of farmers'environmental rights.
