摘 要:废止运输毒品罪的死刑从价值层面、规范层面和实践层面考察都具有较强的可行性。这不仅是因为保留运输毒品罪的死刑不符合"罪行极其严重"的死刑适用标准,与刑罚的正当性价值相背离,而且废止其死刑在毒品犯罪类型中相对易于为公众所接受。此外,从毒品犯罪体系内不同罪名的社会危害性评价以及与《刑法修正案(九)》废止部分死刑罪名的对比分析来看,废止运输毒品罪的死刑亦具备刑罚体系上的正当性。更重要的是,废止运输毒品罪的死刑不会削弱国家严惩毒品犯罪的刑事政策,不会对毒品犯罪的司法治理产生负面影响。The abolition of the death penalty for drugs transporting crime has a strong feasibility in terms of value,regulation and practice.This is not only because the death penalty for the crime of retaining drug transport does not meet the death penalty applicable standard,which deviates from the legitimacy value of the penalty,but abolishing its death penalty is relatively easy for the public to accept in the type of drug crime.In addition,from the social harm evaluation of different crimes in the drug crime system and the comparative analysis with the abolition of some death sentences in the Amendment IX to Criminal Law,the abolition of the death penalty for drugs transportation crime also has legitimacy in the penalty system.More importantly,it will not weaken national criminal policy to severely punish drug crimes and will not have a negative impact on the judicial management of drug crimes.
