摘　　要：2018年6月29日,哈萨克斯坦新版《矿产资源法》及与之配套的油气勘探开发和开发标准合同等正式生效,哈国要求原有现行石油合同延期必须基于新版标准石油合同进行。勘探合同或勘探开发合同的勘探延期,与开发合同延期的审批程序有所不同。与2015版标准石油合同相比,2018版标准石油合同做出了实质的修改和精简。为保证即将到期的石油合同顺利延期,中资石油公司需要做好合同延期前的准备工作,将已签署的合同及其补充协议中的条款与新版标准合同条款进行详细的对比分析,对于合同条款中具有可谈判空间的雇员属地化比例、选择承担建设新的油气处理厂与改造或升级生产设施和处理设施中的一项附加义务等问题,需要提前与哈国能源部沟通和谈判。On June 29,2018,the new version of Kazakhstan’s Mineral Resources Law and its supporting standard contracts of oil and gas exploration and development came into effect and Kazakhstan requires that the extension of the existing oil contract must be based on the new version of the standard oil contract.The approval procedures for the extension of exploration contracts or exploration and development contracts are different from those for the extension of development contracts.Compared with the 2015 standard oil contract,the 2018 standard oil contract has been substantially modified and streamlined.Chinese oil companies need preparing for extension on their signed oil contracts due soon expires,make a detailed comparison and analysis between the signed contract and its supplementary agreement and the new version of the standard contract,and negotiate with the Ministry of Energy of Kazakhstan in advance on issues such as the proportion of employees localization,and the choice of an additional obligations within undertaking the construction and renovation of new oil and gas treatment plants or retrofitting/ upgrading production and treatment facilities.
