环境人格利益的健康权容纳分析--与其他民事权利相比较

摘　　要：环境人格利益是基于人之自然属性而产生的利益,是人在良好环境中生存和发展的非财产性利益,其虽与环境资源有关,但却体现了人之尊严。相邻权、人役权、隐私权等传统民事权利在应对环境人格利益时,或力所不逮,或完全空白。环境人格利益主要包括两个层面的内容:基本生理层面的利益和情感层面的利益。前者从理论上讲可以涵盖在健康权范畴内,但该部分利益与传统健康利益之间差别颇大,其保护只能在传统健康权的基础之上,遗传其一部分特性。同时还要基因重组,成为特殊的健康利益,进而为健康权所容纳;而后者与健康权无关,其应纳入一般人格权进行保护。The environmental interests of personality are the interests based on people’s natural qualities.They are interests for people to live and develop in good environment.They are related to environment,but not interests of properties.Traditional,they reflect dignity of humans.The environmental interests of personality include basic physiological interests and emotional interests.The former can be included in right to health,the latter can be protected through general rights of personality.
