摘　　要：验方是极具价值的中医药资源,但过往我国药品法律侧重西药管理,新近出台的《中医药法》也以保护经典名方为主,目前法律尚无保护验方的专门规定。从专利权、商标权和技术秘密等方面分析验方的保护现状,提出在专利制度、商标制度和技术秘密方面保护验方的法律建议。这些研究有利于保护中医药验方,促进中医药事业的发展。The prescription is a valuable resource of Traditional Chinese Medicine.But in the past,China’s drug laws focused on the management of western medicine.,and the newly released Traditional Chinese Medicine Law also focuses on the protection of classic prescriptions.Currently,there are no special provisions on the protection of prescription.This paper mainly analyzed the protection status of the inspection prescription from the aspects of patent right,trademark right and technical secret,and put forward on the protection of the inspection prescription in the aspects of patent system,trademark system and technical secret from legal aspects.These studies were conducive to the protection of Traditional Chinese Medicine prescription and further development of Traditional Chinese Medicine.
