摘 要:目前,利用信息网络实施的行政违法行为与犯罪行为的处罚范围时有交叉,造成这一现象的原因一方面是因为实务界对于“违法犯罪”这一概念做了扩张性解释,不当地扩大了刑事处罚范围;另一方面是犯罪成立的定量因素缺少统一的认定标准。最新出台的司法解释采用限制性解释的方式在一定程度上限缩了犯罪的成立范围,明确了定量因素的认定标准,但非法利用信息网络罪的适用范围仍有不当扩大的可能性。因此,在司法适用过程中,对此罪定性条件的理解应采用严格解释,且定量因素的认定应参照司法解释的规定综合性地作出实质性判断,从而实现非法利用信息网络罪司法适用的合理限缩。At present,the scope of punishment of administrative illegal acts overlaps with that for criminal acts committed by using information networks.This is partially due to the expansive interpretation of the concept of“illegal crimes”by the practical community,which improperly expanded the scope of criminal punishment;On the other hand,no uniform standards have been formulated for determining the quantitative factors of the establishment of crimes.The latest judicial interpretation has adopted a restrictive interpretation method to reasonably limit the scope of the establishment of the crime and clarify the criteria for determining quantitative factors.However,in order to ensure a reasonable delimitation of the scope of the crime of illegal use of information networks,the interpretation of the qualitative conditions of this crime should be interpreted strictly.The determination of quantitative factors should be based on the judicial interpretation.Restrictions are applicable to judicial use of information network crimes.
