县域法治及其实现机制的样本与进路——以浙江省台州市路桥区为例

摘　　要：作为地方(区域)法治研究的具体化、纵深化,县域法治的社会实证、法律实施与价值评价三维研究在日渐对接,并由议题确立、实例描述阶段进入类型解析、绩效评价阶段。通过以新时代县域法治评估指标体系对某区的持续评估,可以发现,法治运行机制与法治实现机制之间既有联系又有区别,县域实践中更多的着眼点和侧重点是在法治实现机制中的领导机制、程序机制、激励机制、监督机制、传播机制、融合机制上,而在法律与权力的权威度、法律与治理的实效性、权力与权利的能动性、程序与速率之间的优位性上,仍然可能存在着深层紧张关系。法治运行机制本身之中法律的支配地位、解释和适用在决策、改革、执法、监督中应当得到进一步强化,在法治实现机制对法治运行机制的保障与促进上,能够进一步使得后者成为更为能动、自洽、有效的系统工程,而非嵌入、补位或被动的回应。With the deepening of local(regional)rule-by-law research,the three-dimensional research on social demonstration,law implementation and value evaluation of rule-by-law at the country level is becoming more conspicuous.It is developing from the first stage of topic establishment and instance description,to the second stage of type analysis and performance evaluation.Under the background of the new era of socialism with Chinese characteristics,the evaluation index system of rule-by-law at the county level was established to carry out the evaluation of a municipal district.It can be found that the operation mechanism of the rule-by-law and the realization mechanism of the rule of law should be distinguished.In practice,the focus is more on the latter than on the former.Leadership mechanism,procedure mechanism,incentive mechanism,supervision mechanism,transmission mechanism and integration mechanism constitute the mechanism for realizing rule-by-law,which have been paid attention to and strengthened.However,the question of whether law or power should be more authoritative,whether law or governance should be more effective,whether power or right should be more dynamic,and whether the adherence to procedural rules should take precedence over the pursuit of economic efficiency still bring problems.It is believed that the operation mechanism of rule-by-law should be further strengthened,and the guarantee and promotion role of the realization mechanism of rule-by-law should be more dynamic,self-consistent and effective.
