论我国车辆盘查制度的完善——以国外经验为例

摘　　要：盘查,作为一项重要的警务勤务工作,在治安秩序维护以及预防、打击违法犯罪方面发挥着重要的作用。车辆盘查也是近年来道路交通不断发展带来的一项重要的警务工作。但由于我国车辆盘查的性质尚存在争议,相关立法不够完善,加之车辆盘查的启动标准可操作性不强,缺乏对权力的监督与救济,在日常执法执勤中,车辆盘查暴露出的问题越来越多。通过借鉴英美等国的车辆盘查规范,明确车辆盘查的法律性质,确立车辆盘查的法律依据,统一车辆盘查的标准和程序,加强对警察权力的监督以及公民权利的救济,以此完善我国的车辆盘查制度,对防止警察权力的异化,保障公民的合法权益,维护社会的安全与稳定有着重要作用。Investigation is an important means to prevent and combat crime. Vehicle inspection is also an important police work brought about by the continuous development of traffic in recent years. At present, the nature of china’s vehicle inventory is controversial, legal norms can not meet the needs of the times, vehicle inspection of the start-up standard operability is not strong, lack of supervision and relief of power. By drawing on the norms of vehicle inspection in Britain and the United States and other countries, clarifying the legal nature of vehicle inventory, establishing the legal basis for vehicle inventory, unifying the standards and procedures of vehicle inventory, strengthening the supervision of power and the relief of citizens, we can improve the system of vehicle inspection in our country, which plays an important role in preventing the alienation of police power, safeguarding the legitimate rights and interests of citizens, and safeguarding the security and stability of society.
