互联网同城货运型平台规制发展与监管措施--基于货拉拉、快狗打车的案例分析

摘　　要：总结了货运型平台的类别及特征,认为按照发展模式,互联网同城货运型平台可以选择“电子商务平台”模式、“道路货运平台”模式和“电子商务+道路货运”组合体模式,而目前同城货运型平台经营者利用“监管盲区”,游离于“电子商务平台”和“道路货运平台”身份之间,享用“电子商务平台”和“道路货运平台”赋予它的“交易平台权”和“定价权”等各项权力,规避其应承担的“承运人”责任和“依法纳税”义务。因此提出了对于同城货运型平台的规制监管建议:应构建联合监管机制、强化监管效力,督促企业依法运营承担市场主体责任,构建多方公平管理机制严防平台“二选一”,同时应明确行业主管机关对平台APP的管理权限。This paper analyzes the types and features of freight transport platform.In terms of development model,the intercity freight platform can be an“e-commerce platform”,a“road freight platform”model or an“e-commerce+road freight”combined model.At present,the operators of the intercity freight platform use the“supervision blind spot”to blur the identity boundary of“e-commerce platform”and“road freight platform”.Yet they enjoy various rights such as trading platform rights and pricing power which are endowed by“e-commerce platform”and“road freight platform”.Meanwhile,they avoid committing to the“carrier”responsibilities and“tax payment”obligations that they should bear.The main strategies for the regulatory supervision of intercity freight platform include the following:to build a joint supervision mechanism and strengthen supervision effectiveness;to supervise and urge enterprises to obey the law and should the responsibility;to build a multilateral management mechanism;and to clarify the management power of industry authorities on platform APP.
