摘 要:阿拉伯投资法院是目前世界上唯一运行的投资法院,兼具经济一体化与争端解决双重功能。相较于投资仲裁,阿拉伯投资法院具有固定机构与两个审级的优势。从实践经验来看,阿拉伯投资法院具有受国际政治影响大、对缔约国约束力强且管辖权不断扩大的特征。基于对阿拉伯投资法院的考察,就我国参与ISDS机制改革,提出如下建议:我国不宜支持投资法院作为ISDS机制的改革方案;中欧投资协定应避免双边投资法院作为ISDS机制;我国应坚持走自己的路,坚持争端解决多元化,推动构建“一带一路”ISDS机制。Arab Investment Court is the only investment court in the world,and has a dual function of economic integration and dispute settlement.Compared with investment arbitration,Arab Investment Court has the advantages of fixed institution and two trial levels.In terms of the practical experience,Arab Investment Court has the characteristics of being greatly influenced by international politics,strong binding force on the contracting states and expanding jurisdiction.Based on the research on Arab Investment Court,and as for China's participation in the ISDS mechanism reform,we put forward the following suggestions:China should not support the investment court as a reform plan of the ISDS mechanism;the Sino-EU investment agreement should avoid the bilateral investment court as the ISDS mechanism;and China should stick to its own path,persist in the diversification of dispute settlement,and promote the construction of“the Belt and Road”ISDS mechanism.
