采矿权界桩管理问题浅议

摘　　要：采矿权界桩具有矿业权公示、监管标识、侵权警戒等作用。目前并非全部有效采矿权都埋设了界桩。采矿权界桩管理政策刚性的不足可能是矿产资源开采秩序长期以来“治后又乱”循环反复的主要原因。建议:(1)修改完善《矿产资源开采登记管理办法》,强化采矿权界桩管理;(2)修改完善《矿业权人勘查开采信息公示办法》,将采矿权界桩完善状况纳入公示内容;(3)制定采矿权勘界设桩的技术标准和保护政策。The boundary piles of mining right have the functions of publicizing mining right,supervision marks and infringement warning.At present,not all effective mining right have boundary piles.The lack of rigidity in the management policy of the boundary piles of mining right may be the main reason for the long-term repeated cycles of"ineffective governance"in the mining order of mineral resources.Correspondingly,this paper put forward some suggestions:(1)modify and improve the Measures for the Registration Administration of Mineral Resources Exploitation to strengthen the management of boundary piles of mining right;(2)modify and improve the Measures for the Publication of Exploration and Mining Information by Mining Right Owners to incorporate the conditions of boundary piles of mining right into the publicity content;(3)formulate technical standards and protection policies for boundary settlement and pile setting of mining right.
