摘 要:律师调解制度对提升我国调解的市场化、专业化水平,推动我国多元化纠纷解决机制的发展具有重要意义。律师与调解员具有不同的职业属性与角色定位,律师从事调解工作必然带来其身份与角色的转变,角色分离是发展律师调解制度首先需要解决的问题。律师调解员自身应明确这一角色的变化,自觉遵守调解员的行为规范,以保持自身的独立性和中立性。从律师到调解员并非名称的简单改变,角色分离以及胜任新角色的基础在于纠纷解决理念的转变、方法技能上的学习以及评估技巧的把握。Lawyers and mediators have different professional attributes and role positioning.Role separation is the first problem to be solved in the development of lawyer-mediation system.In order to maintain their independence and neutrality,lawyer-mediator should make clear the change of this role and consciously abide by the code of conduct of mediators.Transition from a lawyer to a mediator is not a simple name change.The basis of the role separation and competence for the new role lies in the change of the concept of dispute resolution,the learning of methods and skills and the grasp of assessment skills.It is a problem of great urgency in the development of lawyer-mediation system to improve the professional standard of the lawyer-mediator.
