摘　　要：新闻作品的价值内涵不同于传统作品,在遭遇侵权时按照普通作品计算赔偿额无法体现新闻作品的实际价值,现行《著作权法》规定的赔偿计算方式也需要加以检视。新闻作品著作权损害赔偿额度应坚持实际损失计算标准,采用“市场定价+惩罚性赔偿”的模式,将影响新闻作品市场价值的因素,如作品质量、传播力、媒体影响力等,引入计算模型,对于两次以上侵权或恶意侵权的适用惩罚性赔偿。这有助于解决新闻作品侵权“同案不同判”的问题,有助于推动形成良性的著作权交易市场,实现媒体产业的融合发展。The value connotation of news-related works differs greatly from that of traditional literary works.Their actual value cannot be fully reflected through the infringement compensation with a reference to that of ordinary works.An inspection is also called for the calculation method stipulated by current Copyright Law.The copyright infringement compensation calculation of news works should be implemented through the actual loss measurement,namely,the mode of“market pricing plus punitive compensation”.Punitive compensation is liable for over twice infringement and/or malicious infringement,with an introduction of market factors into the calculation model,such as news works quality,dissemination,media influence,and so on.This significantly contributes to the solution of“different judgments for the same case”,and to the formation of a healthy and benevolent copyright trading market,and to an integrated development of the media industry.
