中国住房公积金管理机构定位困境与顶层设计思考——兼对《住房公积金管理条例》修订的评论

摘　　要：以《住房公积金管理条例》修订历程为切入点,本文深入地讨论了当前住房公积金管理机构的定位问题。研究认为,管理机构现有的各种定位有其合理之处,但将其定位于行政属性难以解决公积金营运中资金的融通与互助功能;定位于储贷属性难以解决资金筹措的基本要求;定位于信托属性则难以解释资金的支配权与收益权,现有体制下也不利于制度的长久存续。基于此,本文认为应在保障资金属地化管理等原则的基础上,逐步推进公积金管理机构改革破解各类定位存在的困境,首先是推进公积金资金融通平台的建设,其次是在融通平台的基础上将公积金中心改组为城市政策性住房银行,最后是拓宽住房银行的投资清单,促进住宅政策性银行发展以及一体化社会保障体系的建构。Based on the revision process of the Regulations on the Administration of Housing Provident Fund,this paper discusses the positioning of the current housing provident fund(HPF)management organization.The research shows that the various existing positioning of management agencies has their own rationality,but it is difficult to solve the financing and mutual aid function of the fund in the operation of HPF by positioning it as the administrative attribute.It is difficult to solve the basic requirements of fund raising when it is positioned as the deposit and loan attribute.It is difficult to explain the right of control and income of funds when it is located in the attribute of trust fund,and it is not conducive to the long-term existence of the system under the existing system.Based on this,this paper believes that we should gradually promote the reform of HPF management institutions on the basis of the principles of localized management of security funds,and solve the difficulties existing in various positioning.Firstly,we should promote the construction of HPF financing platform.Secondly,we should reorganize the management center into urban housing policy banks on the basis of financing platform.Thirdly,we should broaden the investment list of housing banks,and based on this,promote the development of housing policy banks and the construction of integrated social security system.
