摘 要:船舶优先权利历史十分悠久,自其诞生发展至今,学术界和司法实务界对其的探究和迷惑就不曾中断,特别是关于船舶优先权的性质问题。作为一项古老而又被各国传承至今的制度,对其展开研究还是十分必要的,特别是伴随着我国《民法典》的出台,在船舶优先权制度与其融合构建层面存在一些不可逾越的问题,其中就包括船舶优先权的性质问题。因此,本文欲从船舶优先权的历史渊源、域外规定以及我国船舶优先权性质的观点争议及立法现状探究船舶优先权的性质及与现有担保物权体系的融入问题。The maritime lien has a long history.Since its birth,there has always been confusions along with explorations into it during the academic and judicial practice,especially on the nature of maritime lien.As an ancient and inherited system,it is of great significance to study it,especially with the promulgation of the Civil Code of China.There are some insurmountable problems in the system of ship priority and its integration,including the nature of ship priority.In view of the problems,the paper intends to explore the nature of maritime lien and its integration with the existing security interest system from the perspective of its historical origin,foreign provisions and the disputes and legislation status quo of the nature of maritime lien in China.
