德国高等教育法对大学内部治理结构的规范及启示

摘　　要：大学内部治理结构决定了校内权限的分配与运行方式,其合理程度系关大学整体竞争力。德国政府主要依据高等教育法来调整大学的内部治理结构。为了避免法律不当干预大学自治,一方面,高等教育法明确大学的法人地位,以此划定政府与大学的制度边界;另一方面,高等教育法必须接受合宪性审查,以确保法律的结构性规定有利于高校践行基本权利。以德国经验为鉴,我国应明确高校法律地位的公法意义,确保大学章程对校内治理结构的合理安排,并通过备案审查制度监督教育类法律文件的合法性,以提升高校内部治理的效能。The internal gov ernance structure of univ ersity determines the distribution and operation of the authority within the university,which is related to the improvement of the university s overall competitiveness.The German Higher Education Legislation has made a coherent institutional arrangement for the internal governance structure of universities.In order to avoid violating the university autonomy,one hand,the Higher Education Legislat ion delimits the boundaries of gov ernment and university by establishing the legal status of universities;the other hand,the constitutional review would ensure that the legal organization is conducive to the implementation of the basic rights of colleges and universities.Taking German experience as a mirror,China should clarify the legal status of universities by law,improve the rationality of university constitutions for internal governance structure arrangements,and monitor the legality of educational legal documents through the record review system to achieve a rational internal governance structure of universities.
